  1. I have a project, very basic demo - just seeing what I can do. nothing fancy. Of a game in unity 2d. This game uses assets by Celianna and Mack and Lunarea and others, it is not for sale, it is free, and it is made in unity 2d, the demo consists of one map, side scrolling, jumping, double jumping and collision detection.

I am curious if there is an appropriate spot on the forms to share a demo build with the community and see what they think. Considering its made using community resources.
  2. No, there is no place for non-Maker projects here, and depending on which resources you used, you might be in violation of the Terms-of-service.

All RM-RTP-Based resources can only be used in the Maker they are associated with, or in a different maker under the condition that you own both makers.

They must never be used in any non-maker-engine.

There are some resources that may be used in other engines - they're listed with a non-RM-licence in the shop, or if they're not RTP-Based the artist can decide in their terms if they can be used in other engines.

But anything based on Enterbrains RTP is forbidden to be used in a non-Maker engine.
  3. I'm fairly certain all of Celianna's and Lunarea's stuff are RM only.
  4. well its a good thing I asked before doing anything. Thanks guys :D

I have seen games on youtube that are not rpg maker games and they use rpg maker resources that are only allowed to be used in rpg maker engines. Based on what you just said. What legal actions if any are being taken against such people. I respect the license and thats why I asked here before just posting. But I am curious.
  5. http://www.rpgmakerweb.com/products/non-rm

That has the licenses for Non-RM use, if you are using those tiles and buy those licenses (specifically those licenses, they are more expensive then the standard license) you are good.
  6. I think if there's no money being made, and people are just making the games to hand out to friends for fun, Enterbrain probably wouldn't consider it worth their trouble to prosecute. If, however, money is exchanged, it changes the situation.

Please note: my legal expertise comes out of my hat.
  7. I have no intention to go foward with my unity project using these tiles that I have listed. I was just curious. But thank you for the inout

Money has nothing to do with copyright laws.
The reason why some copyright violations are ignored is because they are kept low-profile, so that the original copyright owner does not know about them (or can pretend that he does not know about them).

However, if something becomes high-profile and widely known, then the copyright owner is REQUIRED to move against that project, no matter if it is free or not - simply because the copyright can be voided by inaction if the copyright owner does not take action against known copyright violations.

And there have been cases where free games suddenly became widely distributed and their creators suddenly got a takedown notice...

There is a book author who made a good description of these problems when he was asked about his opinion on fanfic in his universes - the same goes for fangames and basically any protected or licenced content (with some variations depending on the kind of resources of course).

Go to http://www.davidweber.net/faqs/index/series:0 and read the answer to the question about fanfics from January 2011, currently the fourth from top.
  9. Yeah, Enterbrain may not follow it up, but if you're using resources from artists here and you're going against terms of use, we/they WILL follow it up. Commercial or not.
  10. I have been asking some artists who release there stuff - that is designed for rpg maker - but not always hosted on the forums, example deviant art,  if I could use their tiles in a non rpg maker game and have come across no flac. My question is would I still be in trouble - even if they give me permission for their work to be used in non rpg maker games when its clearly designed for rpg maker?
  11. Permission from the creator is what's important. If the person who made th tiles/sprites/whatever either tells you it's okay or says so in their Terms of Use, then you are good.

The original issue involving the RTP comes from the fact that Enterbrain only allows you to use their graphics with the RM programs. They specifically say you can't use ther content with other makers, so you would be in the wrong there.
  12. If they've used RPG Maker resources as a base - ex. edits using RTP (and a vast majority of stuff you'll find out there is edited work), they have to abide by the RTP's terms of service. This means that they can't give you permission to use their work in other game creation software.

So, unless you know with 100% certainty that what you're getting is completely original work that has no ties whatsoever with RPG Maker other than the format, you're better off not using any of them.
  13. Hmm looks like Ill have to write ruby scripts to turn RPG maker vx into a 2d side scroller. I really want to sue these assets in a 2d side scrolling game
  14. Depending on what you want it to do, all of those scripts may already exist. I've played side scrollers made in RM.
