So just a quick question.
Is it considered commercial if all the other games in the series are commercial? I am thinking about moving to commercial with the Oracle of Heroes series. I was looking around and it is not legal to sell games if you do not own the RTP? I was not planning on selling the first game anyway.
Thanks for the help!

If you legally own Ace then you legally own the RTP for Ace. Same for any of the programs. And if you legally own them you can use the RTP in commercial games.
-
OK, but does the first game ( I am not selling ) count as commercial?
-
It depends for what you want it to count.
In most cases no - but for some people it'll count as commercial if that first game is on the same site as later commercial games.
However, that is dependent on the terms of service of the artists/scripters, which means that there is no one answer, the answer is different for different people. -
Ah for game one, I don't have extra add-ons. Just out of the box. Thanks for the help!

How could you not own the RTP? Are you not using a legal version of the engine? If that's the case you shouldn't be releasing a game at all - commercial or not.
-
Oh no. I don't own it because I did the 30 day free trial. I decided I liked VX Ace and XP the best out of all of them, so I got them.
-
Is Oracle of Heroes done in VX then? You would be able to make commercial games with the VX Ace and XP RTP since you've purchased those engines.
And if you want the first few games in a series to be free, but then go commercial with later ones, the first ones would never be considered commercial unless you actually started charging for them too. -
Yeah, the first game is made from VX, the rest are from ace.

Thank you!

If you don't own VX, you really shouldn't be releasing the game. Unless you make the whole thing in your 30-day trial, maybe ...
